Terms of Service

1. Marketplace Role and Ownership

TikTask is owned and operated by [Parent Company Legal Name]. References to "TikTask" include its parent company, directors, officers, employees, and affiliates.

TikTask is a neutral technology platform only. We do not provide services, do not employ providers, and do not control how services are performed.

All services are provided by independent providers on an "as-is" basis.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts.

3. User Accounts

You must provide accurate information and keep your account secure.

TikTask may suspend or terminate accounts for violations, fraud, or abuse.

4. How TikTask Works

Customers may:

• Post tasks
• Book providers
• Communicate through the platform
• Pay securely through TikTask

Providers may:

• Offer services
• Create listings
• Accept bookings
• Get paid through TikTask

Providers control their own pricing, methods, tools, and schedules.

5. Payments, Fees and Escrow

• TikTask charges a Connection Fee to customers
• TikTask charges a Service Fee to providers
• Payments are held in escrow for safety
• Funds are released when the task is marked complete or after 48 hours without dispute

TikTask is not a bank or financial institution.

6. Cancellation and No-Show Rules

Cancellation and no-show rules are shown clearly in the booking interface and apply to all bookings made through TikTask.

7. Disputes

Disputes must be raised within 48 hours of task completion.

TikTask reviews evidence and decides whether payment is released, partially refunded, or fully refunded. This decision is final for platform purposes.

8. Prohibited Activities

Users must not post or perform illegal, hazardous, fraudulent, or licensed work without proper permits.

9. Reviews and Content

Users are responsible for reviews they post. TikTask may remove content that violates policy or law.

10. Intellectual Property

Users grant TikTask permission to use uploaded content for platform operations.

11. Insurance and Risk

• TikTask provides no insurance
• Users accept the risks of meeting others and allowing services at their premises
• Providers must obtain their own insurance

12. Independent Contractor Status

Providers are independent contractors, not employees. They receive no employment benefits and may work for others.

13. Data Privacy

TikTask does not sell user data. Data is handled under our Privacy Policy in compliance with the Philippine Data Privacy Act (RA 10173).

14. Off-Platform Payments Prohibited

Payments for tasks initiated on TikTask must not be made outside the platform.

15. Limitation of Liability

To the maximum extent permitted by law, TikTask's liability is limited to the greater of:

• PHP 10,000, or
• Three (3) times the transaction value

TikTask is not liable for indirect or consequential damages.

16. Indemnification

You agree to indemnify TikTask and its parent company from claims arising from your use of the platform or services performed.

17. Consumer Rights (Philippines)

Consumers retain their rights under the Consumer Act (RA 7394) against the service provider.

18. Safety and Personal Risk

TikTask does not conduct background checks. Users are responsible for their own safety.

19. Governing Law and Venue

These Terms are governed by Philippine law.

• Regular cases: Pasig City / Metro Manila courts
• Small claims: user's local court

20. Mandatory Individual Arbitration

Disputes with TikTask shall be resolved by individual arbitration under PDRCI rules in Pasig City.

If arbitration costs exceed small claims fees for claims under PHP 200,000, TikTask will advance the difference.

21. Changes to Terms

TikTask may update these Terms at any time. Continued use means acceptance.
